The Fair Labor Standards Act (FLSA) protects your right to fair wages whether you are an employee of the state, a county, a fire district or a municipality. The law requires at least a minimum wage for all nonexempt employees working a 40-hour week. An employer is responsible for paying overtime wages of time and one-half a regular wage for all work that exceeds 40 hours in one week.
Firefighters may qualify for overtime pay on a “work period” basis. Qualifying work periods can be between seven and 28 consecutive days. Because of the nature of continuous work hours in this field of duty, when the number of hours worked exceeds the number of hours in a work period, overtime pay is due. However, exhausted and overworked firefighters may have difficulty keeping an accurate record of their work hours.
